1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ClassAI ("Company," "we," "us," or "our") concerning your access to and use of our AI-powered school management platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Definitions

• "Platform" refers to the ClassAI web application, mobile application, and related services
• "User" refers to any individual or institution accessing or using the Platform
• "School Account" refers to an organizational account created by educational institutions
• "Content" refers to all data, information, and materials uploaded or created through the Platform

3. Eligibility

To use ClassAI, you must:

• Be a representative of an educational institution with authority to bind the institution
• Be at least 18 years of age or have parental/guardian consent
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

4. Account Registration and Security

4.1 Account Creation

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access or security breach

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

5. Services and Features

ClassAI provides the following services:

• Student information and academic record management
• Attendance tracking and reporting
• AI-powered timetable generation
• Communication tools for teachers, students, and parents
• Digital certificate generation and verification
• Analytics and reporting features
• Gamification and engagement features

We reserve the right to modify, suspend, or discontinue any feature at any time with or without notice.

6. Subscription and Payment

6.1 Subscription Plans

ClassAI offers various subscription tiers with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis.

6.2 Payment Terms

• All fees are non-refundable unless otherwise stated
• Subscriptions automatically renew unless cancelled
• You authorize us to charge your payment method for recurring fees
• We may change pricing with 30 days' notice to existing subscribers
• Failure to pay may result in service suspension or termination

6.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

7. Acceptable Use and User Conduct

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems or user accounts
• Interfere with or disrupt the Platform's operation
• Use automated systems (bots, scrapers) without authorization
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Use the Platform for any illegal or fraudulent activity
• Reverse engineer, decompile, or disassemble the Platform
• Resell or redistribute our services without permission

8. Intellectual Property Rights

8.1 Our Property

The Platform, including all software, designs, text, graphics, logos, and other content, is owned by ClassAI and protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute our intellectual property without permission.

8.2 Your Content

You retain ownership of content you upload to the Platform. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely to provide and improve our services.

9. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted, error-free, or secure operation
• Results obtained from using the Platform

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLASSAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless ClassAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the Platform, (b) violation of these Terms, (c) violation of any rights of third parties, or (d) your content.

13. Termination

13.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

13.2 Termination by Us

We may suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Prolonged inactivity
• Any reason at our sole discretion

13.3 Effect of Termination

Upon termination, your right to access the Platform will cease immediately. We may delete your account and data after a reasonable period. Sections that by their nature should survive termination will remain in effect.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform.

15. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or use of the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in India.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and ClassAI
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms without our consent
• Force Majeure: We are not liable for failures due to circumstances beyond our control
